Pipes Miles Beckman recently secured summary judgment dismissing all of Plaintiff’s claims in a Title VII discrimination case where a former lieutenant of the Louisiana State Police alleged he was not promoted due to his race. Noting that employment discrimination laws are “not intended to be a vehicle for judicial second-guessing of business decisions” nor to “transform the courts into personnel managers,” Judge Guidry of the Eastern District of Louisiana dismissed Plaintiff’s Title VII failure to promote claim, finding there was no genuine issue of material fact and that the promotees were selected over the plaintiff because of merit, not race.
