PMB Attorneys Secure Favorable Ruling in Fifth Circuit Court of Appeals

Pipes Miles Beckman secured a favorable ruling from the United States Fifth Circuit Court of Appeals affirming summary judgment in favor of the LSU Health Sciences Center in a harassment and retaliation suit brought against it er by a former employee. The Fifth Circuit affirmed the District Court’s decision to grant summary judgment, holding that LSUHSC took prompt remedial action once it knew of an allegation of sexual harassment made against one of its employees. The Fifth Circuit further affirmed dismissal of plaintiff’s claim that being required to move workstations was in retaliation for reporting the harassment, holding that there were legitimate non-discriminatory reasons for moving Plaintiff to a separate workspace.
